Subject: IT2IS Inc. – Procedural request to stay the payment of the final invoice (and associated interest) from the National Contribution Fund – Request for Information
Dear Zineb Arbaoui,
On 6 May 2026, the Commission received an application from IT2IS Inc. (Bravo), requesting a waiver on its final invoice from the National Contribution Fund (the NCF). If a waiver were not granted by the Commission, Bravo requested a 60-month interest-free payment plan.
On 20 April 2026, the Commission received an application from the Canadian Telecommunications Contribution Consortium Inc. (the CTCC), which oversees the operation of the NCF, to approve revisions to the Procedures of the Operation of the National Contribution Fund (the Procedures). The proposed amendments included revisions to interest free deferred payment arrangements of up to 36 months.
On 7 May 2026, Bravo submitted a procedural request requesting an adjournment of its Part 1 application and a stay on the payment of its final NCF invoice and associated interest until the CTCC Part 1 is decided by the Commission.
In order to assess the procedural request, Commission staff requests Bravo to demonstrate that it meets the criteria generally applied by the Commission to assess applications for a stay. These criteria are set out by the Supreme Court of Canada in RJR-MacDonald Inc. v. Canada (Attorney General), [1994] 1 S.C.R. 311 (RJR-MacDonald):
- there is a serious issue to be determined;
- the party seeking the stay will incur irreparable harm if the stay is not granted; and,
- the balance of convenience, taking into account the public interest, favours granting the stay.
In order to complete the record for the expedited proceeding, Commission staff is seeking comments on whether Bravo meets the RJR-MacDonald criteria by 9 June 2026. This information will be posted for comment in accordance with the Commission’s typical processes.
