Dear Bev Kirshenblatt,

Thank you for your procedural request dated 20 February 2026 requesting that the Commission close the above-mentioned application and return it to the applicant (Alliance des producteurs francophones du Canada [APFC]).

In its procedural request, the Canadian Broadcasting Corporation (CBC) argues that the application is inadmissible because the Broadcasting Act does not allow a third party such as the APFC to request a modification of a condition of service while the CBC is in the fourth year of a five-year term. The CBC also indicates that “the issues raised by the APFC clearly extend beyond CBC/Radio-Canada and are being considered as part of the Commission’s current open proceedings to modernize the regulatory framework.”

For its part, the APFC emphasized that the justifications provided by the CBC do not reflect the nature of the application. APFC highlights that the application is not an application to modify the terms of service, but rather a complaint regarding the CBC’s conduct, which, in the APFC’s view, fails to comply with the current terms of service.

The Commission confirms that the APFC’s application concerns the implementation of certain current conditions of service. The Commission finds that the application is therefore admissible and that the grounds raised by the CBC do not justify terminating its review without examining the merits of the application. Furthermore, the APFC’s application does not contain any procedural defects. The Commission finds that there is no basis for closing the case or returning it to the applicant.

Consequently, the Commission rejects the CBC’s procedural request.

As an independent quasi-judicial tribunal, the Commission will render its decision on the APFC’s application while also taking into account the entire record of that application. The deadlines currently established for this proceeding remain unchanged.

This letter and the CBC’s procedural request dated February 20, 2026, were added to the public record of APFC’s application.
