Subject: Application 2022-1013-6 — Part 1 application from Groupe TVA inc. — Dedicated consultation with official language minority communities

Why you are receiving this notice

  1. You are receiving this notice as a group representing the interests of one or more official language minority communities (OLMCs). The Canadian Radio-television and Telecommunications Commission (the Commission) has received an application that could adversely affect one or more OLMCs and would like to hear your views on said application. Your participation in this consultation is voluntary and will help the Commission better understand the potential impacts on the community you represent.

Application background

  1. The Commission received a request from Groupe TVA Inc. to be relieved of its obligation to broadcast at least six special events reflecting francophone life outside Quebec and to remove the weekly 30-minute program on francophone life outside Quebec. These two conditions of service form part of the two requirements the Commission imposes on TVA with respect to the OLMCs, specifically in Broadcasting Decision 2017-147:
    • “The licensee shall broadcast at least six special events per broadcast year reflecting Francophone life outside Quebec.” and
    • “The licensee shall broadcast a weekly 30-minute program on Francophone life outside of Quebec.”
  2. The Commission staff notes that this application could adversely affect the OLMCs outside Quebec, particularly due to a decrease in the number of programs or content featuring Francophones outside Quebec. Removing this obligation could also lead to a decrease in access to information specifically tailored to Francophones in minority communities.

Legal framework

  1. Pursuant to section 5.2 of the Broadcasting Act (the Act), the Commission must consult OLMCs when making decisions that may adversely affect them. Furthermore, under section 41 of the Official Languages Act, positive measures taken with respect to OLMCs must be based on analyses that include dialogue and consultation activities with said OLMCs and with other relevant stakeholders.

Dedicated consultation process

  1. The deadline for submitting comments is 30 March 2026. If you are a group representing the interests of the OLMCs concerned, or if the members of your group belong to an OLMC, you will be given an additional 20 calendar days to submit your comments, up to 20 April 2026.
  2. The applicant will have until 30 April 2026 to submit their reply.
  3. The additional time will allow groups representing the interests of OLMCs to comment on the file, particularly regarding the potential impact of the application on the communities in question, and on any positive or mitigating measures that could be considered.
  4. The application received, along with the submissions from other stakeholders on which the Commission will base its analysis, can be viewed at Public Proceedings.
  5. Consistent with the Canadian Radio-Television and Telecommunications Commission Rules of Practice and Procedure (the Rules), groups representing the interests of OLMCs will be required to provide a copy of their intervention to the applicant when filing their comments with the Commission. In addition, consistent with the Rules, they may also designate as confidential the information referred to in section 25.3 of the Act.

Resources and support

  1. For more details on dedicated consultations, please refer to the Commission’s Guidelines, which are available at: Broadcasting Information Bulletin 2026-26 and Guidelines for broadcasting proceedings affecting official language minority communities and the French-speaking majority in Quebec.
  2. The OLMC Engagement team is also available to answer any questions related to dedicated consultations or to the participation of OLMC representatives in Commission proceedings. This team can be contacted at the following email address: closm-olmc@crtc.gc.ca
