Why you are receiving this notice
- You are receiving this notice as a group representing the interests of one or more official language minority communities (OLMCs). The Commission has received an application that could adversely affect one or more OLMCs and would like to hear your views on it. Your participation in this consultation is voluntary and will help the Commission better understand the potential impacts on the community you represent.
Application background
- The Commission received a request from the Alliance des producteurs francophones du Canada (APFC) regarding compliance with the Canadian Broadcasting Corporation’s (CBC) conditions of service. This request concerned eligible production expenses incurred by independent producers from French-speaking communities (see Conditions of service 2b), 4f), 6f), 8f), 10f) and 16 described in Annex 3 of Canadian Broadcasting Corporation—Various audio and audiovisual services—License renewals, Broadcasting Decision CRTC 2022-165, 22 June 2022). The APFC argues that the Corporation does not account for these expenditures properly, recording the total expenditures for OLMC-Quebec co-productions as French-language OLMC production expenditures, regardless of the proportion of licensing fees held by OLMC producers. This results in an overstatement of French-language OLMC production expenditures reported by CBC.
- The Commission staff notes that this request could adversely affect the OLMCs.
Legal framework
- Pursuant to section 5.2 of the Broadcasting Act (the Act), the Commission must consult OLMCs when making decisions that may adversely affect them. Furthermore, under section 41 of the Official Languages Act, positive measures taken with respect to OLMCs must be based on analyses that include dialogue and consultation activities with them and with other relevant stakeholders.
Dedicated consultation process
- The deadline for submitting comments is 17 March 2026. If you are a group representing the interests of the OLMCs concerned, or if the members of your group belong to an OLMC, you will be given an additional 20 calendar days to submit your comments, up to 7 April 2026.
- The applicant will have until 17 April 2026 to submit his reply.
- The additional time will allow groups representing the interests of OLMCs to comment on the file, particularly regarding the potential impact of the application on the communities in question, and any positive or mitigating measures that could be considered.
- The application received, along with the submissions from other stakeholders on which the Commission will base its analysis, can be viewed at Public Proceedings.
- Consistent with the Canadian Radio-Television and Telecommunications Commission Rules of Practice and Procedure (the Rules), groups representing the interests of OLMCs will be required to provide a copy of their intervention to the applicant when filing their comments with the Commission. In addition, consistent with the Rules, they may also designate as confidential the information referred to in section 25.3 of the Act.
