Updates to the competitive local exchange carrier model tariffs
Summary
In this decision, the Commission approves updates to the competitive local exchange carrier (CLEC) model tariffs and CLEC User’s Guide contained in the CRTC Interconnection Steering Committee Business Process Working Group Task Identification Form report BPRE103c. These updates will provide CLECs with greater regulatory certainty and the information they need to file their Access Services Tariff.
Background
- To enter the local telephony market, competitive local exchange carriers (CLECs) must maintain Commission-approved tariffs for the general terms and conditions associated with the wholesale services they provide to other telecommunications service providers. To facilitate the filing of these tariffs and reduce the regulatory burden for new CLECs, the Commission publishes template documents on its CRTC Interconnection Steering Committee (CISC) website. These documents include CLEC model tariffs and a CLEC User’s Guide.
- Since 2001, the CISC Business Process Working Group (BPWG) has ensured these documents remain useful to industry by reviewing them regularly and proposing updates to the Commission.
- In Telecom Decision 2023-104, the Commission approved Task Identification Form (TIF) report BPRE103b, including updates to the Type I and Type III/IV CLEC model tariffs (CLEC model tariffs) and the CLEC User’s Guide. The Commission also requested that the BPWG finalize its review of all outstanding changes noted in the BPRE103b, update the CLEC model tariffs and the CLEC User’s Guide and file final versions of these documents with the Commission for approval by 17 July 2023.
- By way of Commission letter, this deadline was extended to 30 November 2023.
- On 23 November 2023, the CISC filed the updated TIF report, BPRE103c, with the Commission for approval. The report included revised versions of the CLEC model tariffs and the CLEC User’s Guide. Additional updates to the documents were submitted to the Commission on 16 December 2024.
- The following changes were made to the CLEC model tariffs and the CLEC User’s Guide:
- updates for improved clarity and consistency, including changes to rate tables;
- updates to the User’s Guide to reflect current industry practices;
- changes to the Type I tariff to include Type II CLECs; and
- updates to the names of local exchange carriers.
Commission’s analysis
- The proposed changes to the CLEC model tariffs improve clarity and update the references to incumbent local exchange carrier tariffs. They are generally housekeeping in nature and are helpful to industry.
- Regarding the modification to the Type I Model Tariff to include Type II CLECs, this modification will help facilitate the preparation of the appropriate Access Services Tariff when a mobile carrier wishes to operate as a CLEC. The required changes for use by a Type II CLEC are identified in the CLEC User’s Guide.
- With the Commission’s approval of these versions of the CLEC model tariffs and the CLEC User’s Guide, CLECs will be required to file updated versions of their tariffs with the Commission. Companies updating a CLEC tariff that was previously approved by the Commission can file Group A applications, which, under Telecom Information Bulletin 2010-455-1, do not require Commission approval. Any tariff filings from new CLECs or deviations from the CLEC model tariffs must be filed with the Commission for approval.
Conclusion
- The Commission approves TIF report BPRE103c, including the following tariff-related documents that were included with the report:
- CLECs are required to file updated versions of their tariffs where necessary, in accordance with the process noted above.
- The Commission also reminds the BPWG of its request from Telecom Decision 2023-104 to review and update the CLEC model tariffs and CLEC User’s Guide on a yearly basis and file a TIF report including any required changes and updates to these documents with the Commission for approval.
