Changes to procedure

  1. On 11 September 2025, the Forum for Research and Policy in Communications (FRPC) submitted a procedural request seeking clarity as to whether its costs related to broadcasting matters while participating in this proceeding will be covered, considering the Broadcasting Participation Fund is no longer accepting costs award claims as of 24 October 2025.
  2. The FRPC noted that in Telecom and Broadcasting Notice of Consultation 2025-180, the Commission announced that it will follow the telecommunications costs process for the sake of simplicity and ease of access, but that the Commission is silent on this matter in the present Notice.
  3. The Commission’s approach to funding public interest participation in broadcasting proceedings is being considered through Broadcasting and Telecom Notice of Consultation 2025-94. Until a decision on this proceeding has been published, and in the absence of available funds in the Broadcasting Participation Fund, the established mechanism for obtaining reimbursement of costs will not be available. The Commission considers that using the telecommunications costs award regime for joint broadcasting and telecommunications proceedings that have an emphasis on telecommunications represents an appropriate and reasonable approach, until a decision has been issued for Broadcasting and Telecom Notice of Consultation 2025-94.
  4. In light of the above, the Commission adds the following text to the Notice after paragraph 41:

Applications for costs

As this proceeding is a joint telecommunications and broadcasting proceeding with an emphasis on telecommunications, any broadcasting-related costs incurred by intervenors to participate are inextricable from telecommunications-related costs. As such, all costs applications in this proceeding will use the telecommunications costs process and be reviewed and assessed under the regime set out in the Telecommunications Act.

The Commission considers that active participation of individuals and groups that represent the public interest provides a valuable contribution to its decisions. These individuals and groups may require financial assistance to effectively participate in Commission proceedings.
