Subject: Follow up to Telecom Decision 2023-196 - Cable Carrier Phase II Manuals – Request for extension
On 8 April 2024, further to the Commission’s direction in Telecom Decision 2023-196, Bragg Communications Inc., carrying business as Eastlink, Cogeco Communications Inc., on behalf of its affiliate Cogeco Connexion Inc., Rogers Communications Canada Inc. (“Rogers”), and Quebecor Media Inc., on behalf of its affiliate Videotron Ltd. (“Videotron”) (collectively, the “Cable Carriers”) filed company-specific Phase II Regulatory Economic Studies Manuals (the Manuals).
On 23 September 2024, Commission staff requested additional information (RFIs) regarding the Manuals. The Cable Carriers were requested to file responses with the Commission by 16 October 2024.
On 26 September 2024, the Commission received a procedural request from the Cable Carriers to extend the filing date for the RFI responses to 8 November 2024 for all parties. The Cable Carriers stated that since the majority of questions contained in the RFIs relate to portions of the Manuals that were jointly developed by the Cable Carriers, additional time would be required for collection of internal inputs, validation and coordination between the Cable Carriers in order to produce complete and accurate information. Rogers and Videotron also noted that they are currently preparing RFI responses regarding cost studies submitted in the proceeding initiated by Notice of hearing – Review of the wholesale high-speed access service framework, Telecom Notice of Consultation 2023-56, and as such would be unable to respond to both RFIs in the allotted time.
Given the above, Commission staff is of the view that an extension is necessary to allow time for parties to adequately respond to the RFIs.
The deadline for filing responses to the RFIs is therefore extended to 8 November 2024.
