Re: Tariff Notice (TN) 41 from Cogeco Cable Inc – Introduction of a service condition for 10 GigE interfaces

Dear Mr. Messier:

The Commission received an application from Cogeco Cable Inc. (Cogeco), dated 20 August 2013 in which the company proposed to amend its third party Internet access (TPIA) Tariff to make the provision of 10 Gigabit Ethernet (GigE) interface ports conditional on a minimum capacity commitment.

Commission staff has determined that additional information is required to complete its assessment of this application. Commission staff is thus requesting that Cogeco submit responses to the attached interrogatories by 27 November 2013.

All parties may file written comments to the Commission by 4 December 2013. Cogeco may file reply comments by 11 December 2013.

Refer to Cogeco’s tariff notice 41 where the company proposed to provide a 10 GE interface only under the conditions that the capacity ordered by the TPIA customer is equal to or greater than 3 Gbps and that the TPIA customer maintains a capacity order of at least 3 Gbps on each 10 GE interface.

1. For the five largest ISPs operating in Cogeco’s territory, based on the most current information:
a) Provide the number of 1 GigE and 10 GigE interfaces per each ISP.
b) Provide the number of end-users for each ISP, and identify the vintage of the data.
c) Provide the total monthly average traffic (downstream and upstream) for each ISP for the last twelve months.
d) Provide the average monthly amount of capacity that each ISP purchased from Cogeco for the last twelve months.
2. For the five largest ISPs operating in Cogeco’s territory and for the next three years:
a) Provide the forecast of end-users per year for each ISP
b) Provide the forecast of total monthly average traffic (downstream and upstream) per year for each ISP.
c) Provide the forecast amount of capacity per year for each ISP.
3. In the event an ISP having one or multiple 1 GigE interfaces orders an upgrade to one or multiple 10 GigE interfaces,
a) Identify the sequence of major activities and the time frames required for each activity for processing a request to upgrade, with supporting rationale. Further, identify the minimum and average time that the company expects it would require for processing a request to upgrade from a 1 GigE to a 10 GigE interface.
b) Explain how the costs for an upgrade from a 1 GigE interface to a 10 GigE interface will be charged to the ISP.
c) Explain whether or not there will be any service disruption through upgrading. If so, would it be minimal or significant. Further explain the nature and expected duration of any disruption.
