RE: Fido Solutions Inc. Tariff Notice 23 and Rogers Communications Partnership Tariff Notice 32

Dear Sirs:

On 25 April 2013, the Commission received applications by each of Fido Solutions Inc. and Rogers Communications Partnership (RCP) under Tariff Notice 23 (TN 23) and Tariff Notice 32 (TN 32), respectively. Each company proposed revisions to item 201.2 of its Access Service Tariff - Termination of Traffic from Exchanges within ILEC Local Calling Area.

Fido proposed to revise the rate charged to equal the maximum imbalance rate contained in the corresponding incumbent local exchange carrier's (ILEC's) imbalance
tariff for local interconnection on a local interconnection region (LIR) basis. Fido submitted that it has been using only LIR-based architecture and no longer uses the exchange-based regime.

RCP submitted that in Ontario it operates on an LIR basis in various locations. It proposed to amend the Ontario section of item 201.2 to add the sentence “LIR-regime - See rates for Termination of Intra-LIR Traffic when traffic imbalance is greater than 90%”.

Each company submitted that its proposed changes were similar to the modifications that Vidéotron Télécom Ltée (Vidéotron) had proposed in its Tariff Notice 40 (TN 40).

Commission staff notes that the outcome of the Vidéotron TN 40 proceeding could affect the outcome of the Fido TN 23 and Rogers TN 32 proceedings.

Consequently, the Commission will not dispose of these applications until the proceeding related to Vidéotron’s TN 40 is complete. Therefore, these applications, along with all associated subsequent revisions, have not been approved on an interim basis on the 15th calendar day following receipt.
