This is in response to your procedural letter dated 24 September 2013 in which you request the opportunity to file additional comments in response to Newfoundland Broadcasting Ltd.’s (CJON-DT) reply submissions that were filed on 17 September 2013. In your letter you submitted that CJON-DT filed additional arguments as a part of its reply relating to its argument that it had been encouraged by the Pattison group to apply for inclusion in the SMLPF as well as in relation to arguments concerning the notion of “market served”.

Commission staff invites SMITS to file and serve an additional response to the CJON-DT reply to interventions by no later than 15 October 2013. However, SMITS must limit its comments only to arguments made by CJON-DT regarding the notion of it serving a “market served” as well as arguments raised with respect to the Pattison groups apparent encouragement. CJON-DT shall serve and file its reply by no later than17 October 2013. The record will be considered closed on 17 October 2013.

The Commission will decide whether to take the additional information into account when it makes its decision on the application.

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
