RE: Tariff Notices TCC 371/371A, TCI 624/624A, and TCBC 4332/4332A
Please find attached interrogatories related to Globalive Wireless Management Corp.’s (Globalive’s) comments regarding applications by TELUS Communications Company (TCC) filed under cover of the above-noted tariff notices. In these applications, TCC proposed to amalgamate the company’s tariffs related to interconnection by wireless service providers.
Responses to these interrogatories are to be filed with the Commission by 26 October 2009.

Refer to paragraphs 16 and 18 of Globalive’s comments dated 25 September 2009, in which Globalive stated the following:
Paragraph 16. …it is unclear to us how TELUS could unilaterally cancel existing contracts given that they are legally binding and do not permit termination by TELUS other than in the context of a counterparty breach or insolvency.
Paragraph 18. Globalive Wireless expended significant effort and resources over months of difficult negotiations to conclude this agreement with TELUS.
1. Clarify whether ‘existing contracts’ in paragraph 16 and ‘this agreement’ in paragraph 18 refer to the standard WSP network access service agreement.
2. If not, clearly identify the agreements /contracts to which you are referring.
