RE: Bell Canada Tariff Notice 7223 and Bell Aliant Tariff Notice 287


On 24 September 2009, the Commission received the above-mentioned tariff notices submitted by Bell Canada and Bell Aliant Regional Communications, Limited Partnership (collectively, the companies). The companies indicated that their applications were filed as Group A filings under Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008 (Decision 2008-74).


Commission staff considers that the applications do not meet the definition of Group A filings as indicated in Appendix 1 of Decision 2008-74. In particular, they do not meet part (a) of the definitions of Group A filings in that they include a proposed rate change to an item that is not “a change to a previously approved rate for a retail service where the revised rate meets the Commission’s price cap or price regulation rules” [emphasis added]. Specifically, the companies have proposed a rate increase to Special Facilities Tariff, Item B53, Enhanced 9-1-1- arrangements, which is assigned to their respective Services with frozen rate treatment baskets.

 

In light of the above, these applications are closed. The Commission is willing to consider new applications, addressing the above noted issue.
