Re:  TCI Tariff Notice No. 198 - OC-12 Access and Inter-exchange Channels

On 31 January 2006, the Commission received Tariff Notice 198 from TELUS Communications Inc. (TCI) proposing revisions to its Special Facilities Tariff to introduce Item 693 - OC-12 Access & Inter-exchange Channels - Alberta ( Edmonton - High Level).

Commission staff notes that the proposed Item 693 stipulates the provision of one OC-12 channel and one OC-12 local access under a 10-year initial contract period, with an automatic renewal provision for one (1) successive 10-year renewal term.

TCI has provided a Customer Specific Arrangement (CSA) Type 2 imputation test with a study period of 20 years. However, the contract can be terminated upon completion of the initial contract period of 10 years. Commission staff considers that since the commitment is only for an initial 10-year period, the imputation test should have reflected a 10-year study period.  Consequently this file is closed.

However, the Commission is open to examining a new application from the company that addresses the above issue. The application must be filed under cover of a new tariff notice.
