Third-party Internet access service

The Commission received an application by Shaw Cablesystems G.P. (Shaw), dated 3 January 2003, to add Special Facilities Tariff (SFT) item 103, Third Party Internet Access Service, in order to provide service to Internet service providers.

In Terms and rates approved for large cable carriers' higher speed access service, OrderCRTC 2000-789, 21 August 2000 (Order 2000-789), the Commission approved, on an interim basis, the cable carriers' proposed Terms of Service and related agreements for the provision of higher speed access services to Internet service providers. Further, in Order 2000-789, the Commission approved on a final basis, the per end-user access rates and volume usage rate restrictions.

In Order 2000-789, the Commission directed the cable carriers to issue, by 20 September 2000, amended tariff pages and to file revised service agreements reflecting the Commission's determinations.

Pursuant to Order 2000-789, Shaw filed Tariff Notice (TN) 4 dated 13 July 2001, requesting approval of proposed rates and charges for third-party Internet access service. Pending the Commission's determination regarding TN 4, Shaw requested that the Commission approve on an interim basis TN 5.

In light of the above, the Commission approves on an interim basis Shaw's application. The revisions take effect as of the date of this order.
