RESALE AND SHARING OF CELLULAR SERVICES
On 7 May 1990, the Commission received an application from Corpfon Cellular (Corpfon) against Rogers Cantel Inc. (Cantel). Corpfon stated that Cantel had refused to provide it with cellular service pursuant to Cantel's Million Minute Plan, on the grounds that Corpfon was planning to resell the service.
On 15 June 1990, the Commission received an application from Dial-Mobile Rent-A-Phone Inc. (Dial-Mobile) against Bell Cellular Inc. (Bell Cellular). Dial-Mobile indicated that Bell Cellular had provided notice of intention to terminate cellular service provided to Dial-Mobile pursuant to Bell Cellular's Partner Plan, on the grounds that Dial-Mobile was reselling its cellular service.
Having considered submissions from both parties, the Commission indicated, by letter dated 17 July 1990, that Bell Cellular was not to terminate service to Dial-Mobile while the matter was before the Commission.
On 10 July 1990, the Commission received a further application from Corpfon, this one against Bell Cellular. In its application, Corpfon stated that Bell Cellular had refused to provide cellular service to Corpfon pursuant to its Partner Plan, on the grounds that Corpfon was planning to resell the service.
On 19 July 1990, the Commission received an application from Cellular Rental Systems Inc. (Cellular Rental) indicating that it was in a situation virtually identical to that of Dial-Mobile and requesting that Bell Cellular treat it in the same manner as Dial-Mobile.
The above mentioned applications have raised the issue of the resale and sharing of cellular services. In various previous decisions, the Commission has found that resale and sharing of other telecommunications services were in the public interest.
Interested persons are invited to comment on the issue of resale and sharing of cellular services provided by all of the federally regulated cellular providers, including whether such resale and sharing is in the public interest and, if so, what restrictions, if any, would be appropriate.
The Commission had decided to establish the following procedure:
1. Bell Cellular, B.C. Cellular Limited, Cantel, The Island Telephone Company Limited, MT&T Mobile Inc., The New Brunswick Telephone Company, Limited and Newfoundland Telephone Company Limited (the cellular providers) will be considered parties to this proceeding.
2. Interested persons wishing to participate in this proceeding (interveners) must notify the Commission of their intention to do so by writing to Mr. Alain-F. Desfossés, Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, by 4 October 1990. The Commission will issue a complete list of parties and their mailing addresses.
3. By 18 October 1990, the cellular providers shall file with the Commission, serving copies on interveners and on each other, a statement of:
a) their present practices and policies with respect to the reselling and sharing of cellular services, identifying all relevant tariff and contractual provisions;
b) their position with respect to whether resale and sharing of cellular services is in the public interest; and
c) in the event that the Commission were to find such resale and sharing to be in the public interest, their views on any restrictions that would be appropriate.
4. Interveners may submit comments to the Commission, serving copies on the cellular providers, by 8 November 1990.
5. The cellular providers may submit reply comments to the Commission, serving copies on interveners and on each other, by 22 November 1990.
6. The documents associated with the applications by Corpfon, Dial-Mobile and Cellular Rental will form part of the record of this proceeding. In the case of Corpfon, the Commission has placed an abridged version of its application regarding Cantel and certain associated documentation on the public record.
7. The documents referred to in paragraph (6) can be examined at the offices of the CRTC in the following locations:
